The best results for all stakeholders of the distressed business enterprise are most often realized through early, enlightened intervention and candor, communication and objectivity, along with the organized involvement and cooperation of all constituencies The firm is a recognized leader in out of court business restructurings for small and large enterprises and one of the earliest proponents of expedited (“pre packaged” or “fast track”) Chapter 11 cases which reduce the cost, delay and frictional losses that can accompany the bankruptcy reorganization process. When representing stakeholders or potential acquirers of troubled or illiquid businesses Brooks & Raub uses its familiarly with the bankruptcy process to facilitate the identification and efficient realization of client objectives. Complementing the success of the firm on behalf of clients in consensual arrangements and resolutions, Brooks & Raub has an able and ready courtroom capacity for situations where the interests of clients and adverse parties can not be reconciled. We provide diligent, cost effective representation of clients in litigation arising in Chapter 11 and other bankruptcy cases. We are typically called to address matters that are urgent and vital to our clients, requiring the seasoned judgment of skilled professionals. For this reason, the firm does not include junior lawyers and consists of four senior attorneys, each with over 20 years of specialized legal experience, able to prosecute the resolution of complex business and financial problems. Our representations often include close coordination with existing client professionals to leverage their expertise and client specific knowledge to achieve a more efficient and effective result. Our practice includes all types of business organizations ranging from private and venture funded start-ups to public companies with well established operating histories to governmental entities.
